General Data Protection Regulation Policy (GDPR)
For purposes of this Section, “PII” means information relating to an identified or identifiable natural person that you provide to Company or that Company otherwise acquires from or on behalf of you, your affiliates or any of their respective personnel or agents in connection with the provision of services under this Agreement, whether in written, oral, electronic, or other form, and any copies thereof. An identifiable person is a person who can be identified, directly or indirectly, by reference to an identification number or factors specific to his or her physical, physiological, mental, economic, cultural or social identity. Examples of PII include, but are not limited to, the following: account number (bank account, credit card, etc.), address, biometric identifier, license or identification number, date of birth, government identifiers (such as social security numbers), name, personnel number, photograph or video identifiable to an individual, vehicle identifier or serial number, and may also include other information related to an individual that may directly or indirectly identify the individual (e.g. salary, performance rating, purchase history, call history, etc.).
Company will implement and maintain reasonable and appropriate administrative, technical, and physical safeguards to (i) ensure the security and confidentiality of PII; (ii) protect against anticipated threats or hazards to the security or integrity of PII; and (iii) protect PII from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into due account the risks involved in the processing and the nature of the PII.
Company shall comply with the confidentiality, privacy, and data security requirements of any federal, state, or local law or regulation in the United States that is applicable to it in connection with the performance of services under this Agreement.
If your business is located in any of the member states of the European Union, or otherwise has access to the PII of “data subjects” within the European Union for purposes of the European Union’s General Data Protection Regulation (GDPR), https://gdpr-info.eu, you agree to notify Company in writing or by e-mail and obtain Company’s consent prior to making any such PII available to Company, and to indemnify Company and hold it harmless from and against any liability Company may incur as a result of Company’s use of such PII in accordance with the provisions of this Section and Company’s Privacy Policy.
If you are located in the EU or the UK, you have the following rights with respect to how Company processes your personal data. You have the right to request (i) a copy of the personal data that Company has about you, (ii) that Company correct the information about you if you believe it to be inaccurate, and (iii) that Company erase or refrain from using your personal data. This is not an absolute right, and, in some circumstances, Company may decline to erase or limit its usage of your data, such as when Company has an ongoing business relationship with you, or we are legally required to retain the information. If Company cannot honor your request, Company will inform you of this fact as well as the reasons for Company’s decision.
Additionally, you also have the right to raise any objections regarding the processing of your personal data and to raise any concerns you may have about Company’s processing of your personal data.
To exercise any of these rights, or to make an objection or raise any other concerns by submitting your concerns to legal@www.rootsnfruits.com.
While we hope that Company can resolve any of your privacy concerns to your satisfaction after you contact us directly, you also have the right to file a complaint regarding Company’s handling of your personal data with the EU data protection authorities (DPAs) and/or the Information Commissioner’s Office (the UK’s Data Protection Authority).
Selling, Sharing and Use of Personal Information
Company does not “sell” this information for money. However, we engage in routine online activities with third parties in ways that could be considered a “sale” or “sharing” as defined under applicable law. If you would like to opt-out of the use of your personal information for these purposes, you can submit this request by contacting us at legal@www.rootsnfruits.com.
Your Rights
Certain states have privacy laws that provide consumers with rights regarding their personal information, such as the right to request specific information about what information Company has collected about you, a copy of your personal information, corrections to inaccuracies in the personal information Company maintains about you, and the deletion of your personal information.
These rights are not absolute, and in some circumstances, Company may decline to satisfy your request. For example, if we are unable to verify your identity or if your request impacts other people’s privacy rights, we may deny your request to exercise these rights. We may also deny your request when Company has the legal right to do so, such as when we have an ongoing business relationship with you, an ongoing need to use the information for purposes outlined in this Privacy Policy, or we are legally required to retain your personal information. If Company denies your request to exercise your privacy rights, we will tell you why we are denying the request and provide you with information about how to appeal this decision.
Changes to This Privacy Policy
If we make any material changes to this Privacy Policy, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Website prior to the change becoming effective. We encourage you to periodically review the Website for the latest information on our privacy practices. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Company Services.
